Leave Not Due (LND) Max 360 days in entire service (180 days without MC). Advance debit against future HPL accrual.
  • Sanctioning authority must be satisfied officer will return to duty.
  • Recovered from pay if employee quits voluntarily before earning back HPL.
Extraordinary Leave (EOL) Max 5 years continuous absence limit. No leave salary payable.
  • Granted when no other leave is admissible or employee applies in writing.
  • May count for pension/increments if granted on MC or higher studies.
Maternity Leave 180 days per spell. Miscarriage/Abortion: Max 45 days. Full pay leave allowance.
  • Admissible to female employees with less than 2 surviving children.
  • Combinable with any other kind of leave without medical certificate up to 2 years.
Paternity Leave 15 days per spell. Full pay leave allowance.
  • Admissible to male employees with less than 2 surviving children.
  • Must be availed within 15 days before or 6 months after delivery/adoption date.
Child Care Leave (CCL) Max 730 days across entire service. 100% pay for 1st 365 days; 80% pay for next 365 days.
  • For female employees & single male parents caring for up to 2 oldest children under 18.
  • Max 3 spells per calendar year (min 5 days per spell).
Child Adoption Leave 180 days for female; 15 days for male. Full pay leave allowance.
  • Granted on valid adoption of a child below 1 year of age.
  • Admissible to employees with less than 2 surviving children.
Study Leave Max 24 months in service (36 months for CHS officers). Leave salary equal to last pay drawn (less stipend/scholarship).
  • Requires min 5 years continuous service; must execute a service bond.
  • Granted for higher studies directly related to sphere of official duty.
Work-Related Illness & Injury Leave (WRIIL) Full hospitalization period + post-hospitalization allowance. 100% pay during hospitalization & initial 6 months post-hospitalization.
  • Replaced Special Disability Leave under Rule 44.
  • No EL/HPL is debited or credited during WRIIL period.

2. General Principles Governing Grant of Leave

  • Right to Leave: Leave cannot be claimed as a matter of right[cite: 1]. The Leave Sanctioning Authority may refuse, curtail, or revoke leave of any kind, but cannot alter the kind of leave applied for[cite: 1].
  • Conversion of Leave: Conversion of one form of leave to another must be applied for within 30 days of completing the relevant spell of leave[cite: 1].
  • Maximum Continuous Absence: No Government servant shall be granted leave of any kind for a continuous period exceeding 5 years except with the sanction of the President[cite: 1].

3. Overstayal of Leave & Unauthorized Absence

  • Overstayal Debit: Unsanctioned overstayal of leave is debited against the employee’s HPL account to the extent available, and the excess is treated as Extraordinary Leave (EOL)[cite: 1].
  • Financial & Service Impact: No leave salary is admissible for the overstayed period[cite: 1]. Overstayal does not count for increments, leave earning, or pension benefits[cite: 1].

4. Medical Certificate (MC) Requirements

  • CGHS Beneficiaries at Head Quarters: Must produce a Medical Certificate / Fitness Certificate issued by a CGHS Doctor[cite: 1].
  • Non-CGHS / Outstation Employees: Must produce a certificate from an Authorized Medical Attendant (AMA)[cite: 1].
  • Non-Gazetted Staff Exemption: May submit an MC from a Registered Medical Practitioner (RMP) if no AMA is available within an 8 km radius of their residence[cite: 1].
